Bail/Pretrial Detention

The New Jersey criminal justice system recently implemented bail reform. This is the single largest change in New Jersey’s criminal law in the last 20 years. This change specifically affects those who have been arrested, and if and how they are going to be released.

As a result of bail reform, a criminal defendant must now be evaluated by the criminal division and a report is formulated. This report will contain a defendant’s PSA score. Based on the score, the prosecutors will either move for detention or they will release you with conditions. If you are held for detention, a hearing will be conducted within a couple of days to determine if the court can release the defendant with conditions, or if they will be held throughout the pendency of the case in the county jail without bail.
